These Terms and Conditions (“Terms”) govern your use of the FamilyMap mobile application, website, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms.
1. Eligibility
The Services are intended for use by adults, parents, guardians, and authorised family members.
You represent that:
- You are at least 18 years old, or
- You have parental or legal guardian permission to use the Services.
Children may only use the Services under appropriate parental supervision.
2. Consent to Location Sharing
The Services operate on voluntary location sharing between users.
By enabling location permissions and joining a family or group, you consent to sharing your location information with authorised members of that group.
You acknowledge that:
- Location sharing requires explicit device permissions,
- Users may stop sharing at any time,
- The Services are not intended for covert tracking or surveillance,
- All participants should be informed of location sharing.
Modern app marketplace policies require explicit user consent for location-sharing functionality.
3. Accounts
You may be required to create an account to use certain features.
You agree to:
- Provide accurate information,
- Keep login credentials secure,
- Be responsible for activity under your account.
We may suspend or terminate accounts that violate these Terms.
4. Permitted Use
You agree not to:
- Use the Services unlawfully,
- Use the Services to stalk, harass, abuse, or monitor individuals without consent,
- Circumvent device permissions or operating system protections,
- Reverse engineer or interfere with the Services,
- Attempt unauthorised access to accounts or systems.
The Services are intended solely for legitimate family safety and coordination purposes.
5. Emergency Features Disclaimer
Some features may include:
- SOS alerts,
- Crash detection,
- Emergency notifications,
- Driving safety information.
These features are supplemental tools only.
We do not guarantee:
- Emergency response,
- Continuous service availability,
- Accurate location updates,
- Detection of all accidents or emergencies.
Users should not rely on the Services as a substitute for emergency services or professional safety systems.
6. Subscriptions and Payments
Some features may require a paid subscription.
Subscriptions may automatically renew unless cancelled through your Apple App Store or Google Play account settings before renewal.
Fees are non-refundable except where required by law.
7. Intellectual Property
All software, content, branding, trademarks, graphics, and technology associated with the Services are owned by or licensed to FamilyMap.
You may not reproduce, distribute, modify, or exploit any portion of the Services without written permission.
8. Privacy
Your use of the Services is also governed by our Privacy Policy.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, including:
- Merchantability,
- Fitness for a particular purpose,
- Non-infringement,
- Accuracy or uninterrupted availability.
10. Limitation of Liability
To the maximum extent permitted by law, FamilyMap shall not be liable for:
- Indirect or consequential damages,
- Loss of data,
- Loss of profits,
- Personal injury,
- Missed alerts or delayed notifications,
- Inaccurate location information,
- Third-party actions or misuse of the Services.
Our total liability shall not exceed the amount paid by you for the Services during the preceding 12 months.
11. Suspension and Termination
We may suspend or terminate access to the Services if:
- You violate these Terms,
- Misuse or abuse is suspected,
- Continued operation becomes unlawful or impractical.
You may stop using the Services at any time.
12. Modifications
We may modify the Services or these Terms from time to time.
Continued use after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
Except for disputes that can be brought in small claims court, all disputes between you and us, including any dispute regarding this Agreement, shall be exclusively settled through binding arbitration through the American Arbitration Association (“AAA”) pursuant to the AAA’s then-current rules for commercial arbitration. Any such arbitration proceeding will be conducted solely in English.
These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. If the arbitration in this section provision is found unenforceable or not to apply for a given dispute, then the proceeding must be brought exclusively in a court of Delaware jurisdiction.
